The Malacca Bar Committee paid a courtesy call to the Melaka Judiciary and introduced themselves to the Melaka High Court Judge, Justice Datuk Anselm Charles Fernandis and the other Judicial Officers.

The Malacca Bar Committee paid a courtesy call to the Melaka Judiciary and introduced themselves to the Melaka High Court Judge, Justice Datuk Anselm Charles Fernandis and the other Judicial Officers.

The Committee then met with the Bench and the Public Prosecutor’s Office, which was led by Tuan Ahmad Sazali B. Omar.

Warm greetings were exchanged, as Justice Datuk Anselm Charles Fernandis welcomed the Committee Members and the Malacca Bar Committee Chairman, Ms. Foo Qiao Wei (Amber), recorded the Malacca Bar’s appreciation to the members of the Bench for making time to meet with the Committee.

Ms. Amber then introduced the Committee Members and their respective portfolios.

A fruitful discussion concerning the issues raised during the meeting ensued, with all parties committing to practical solutions and the interests of justice.

The Malacca Bar Committee will be issuing a circular on the outcome of the meeting in due course.

The Malacca Bar Committee organized a talk entitled “Family Law for Beginners: Divorce, Annulment, Child Custody, Maintenance & Access” from 3.00 pm – 5.00 pm at the Malacca Bar Auditorium.

36 participants (20 pupils-in-chambers, 12 members and 4 non-members) signed up for the talk.

Mr. Shanker Sundaram shared on the definition of marriage and divorce and the difference between a dissolution and an annulment of a marriage. Mr. Shanker also explained the rights of parties involved in a divorce petition and shared his experience in handling family law cases in court in order for the participants to have a better understanding on the procedure in court and what should be expected in such cases.

Our Chairlady, Ms. Amber Foo, presented the token of appreciation to Mr. Shanker. The Committee hopes that members would have a better understanding on family law matters and that it would be beneficial to their practice in future.

K.P. Ng & Karen Cheah Futsal Challenge (16 July 2022)

The annual K.P. Ng & Karen Cheah Futsal Challenge was held on Saturday, 16.07.2022 at Batu Berendam Sports Complex after being called off for 2 rounds due to the Movement Control Orders that had been in force since 2020.

Teams SIU F.C (“SIU”), Shallow F.C (“SHALLOW”) & Legend F.C (“LEGEND”) participated in the K.P. Ng Futsal Challenge. The team captains for the team were Mr. Faathir Imran, Mr. Aiden & Mr. Mahaiyuddin respectively.

The games kicked off at 2.15 pm between SIU and the all-time favourite, LEGEND.  LEGEND was controlling the game and it ended with a 1 – 1 draw. The 2nd game was a battle between SIU and the underdog, SHALLOW. To the surprise of all, SHALLOW took an early lead by Mr. Senthil’s long range effort. That was an important first goal and SHALLOW defeated SIU at the end of the game by 4 – 1 unexpectedly.

The deciding game was between SHALLOW and LEGEND. SHALLOW lost their confidence after conceding 4 goals in the first half alone. SHALLOW manage to score a late consolation goal but it was not enough to bring the game back. The final score was 7-1. Nonetheless, spectators have claimed that the score doesn’t reflect the battle as the match was quite even.

C.C.F.C (“CC”) & Syahbandar F.C (“SYAHBANDAR”) were the only 2 teams participating in the ladies’ category. The ladies played the game at a slow but comfortable pace. Audience witnessed some sensational goals and the game ended in 3-2 victory by CC.

Malacca Bar Committee would like to take this opportunity to congratulate both LEGEND and CC for winning the tournaments.

Legal Aid Training (20th May 2022)

The training was organized by the Malacca Bar Committee on 20th May 2022 from 2.30pm – 5.30pm at the Malacca Bar Auditorium, where 30 participants / pupils-in-chambers were present. The training was to enable the pupils to carry out their Legal Aid and Dock Brief duties in court.

The four speakers for the training were:

  • Mr. Chia Cheng Wee
  • Mr. Faiezad Razali
  • Mr. Ng Fun Boon
  • Ms. Loong Meng Si

The trainers shared their experience practising in criminal litigation and conducted a group training, where participants were placed into four groups and given a scenario for the participants to present on.

The training ended at 5.45pm. The Committee hopes that the pupils would now have a better understanding on how to handle criminal matters, specifically how proper mitigation and application for bail are done, and that what they have learned will be put of use to their criminal practice in future.

Talk: Cross-Examination in Criminal Litigation (30 June 2022)

On 30 June 2022, 30-odd participants attend a talk on Cross-Examination in Criminal Litigation – The Do’s and Don’ts at the Malacca Bar’s premises by Mr. K. Theivaendran.

After giving a brief run-down on the different stages of trial, Mr. Theivaendran shared extensively on the preparation preceding trial, pausing to remind participants that the key to an effective cross-examination is to be prepared before the cross-examination, especially in criminal litigation, where the file is often miniscule compared to a civil litigation file. A thin file does not necessarily mean a total absence of information, or the means to find it.

Some key takeaways from the talk:

  • Know your subject-matter | What area of law does this case involve?
  • Know your charge | A charge is like an exam question; you only get marks if you answer the question.
  • Know your case inside and out | Take practical steps to glean information.
  • Know your witness and your judge | Adapt accordingly.
  • Denial is not a defence | What is your client’s story?
  • Know when to lead | And when to stop.

The talk ended at 5.00PM, after which Ms. Desiree Teh presented a token of appreciation to Mr. Theivaendran on behalf of the Malacca Bar.

After the talk, some participants stayed back to mingle over refreshments and to speak further with Mr. Theivaendran.
