On the 16th of July 2020, the Malacca Bar Committee was privileged and honored to be able to pay a courtesy visit to our newly appointed Malacca High Court Judge, Yang Arif Tuan Anselm Charles Fernandis of High Court Melaka 1. We had a fruitful session and a number of matters were discussed in general terms. Yang Arif Tuan Anselm also expressed his keenness in having a Bench and Bar meeting once we are able to do so. We would like to record our appreciation to Yang Arif Tuan Anselm for a productive session with the Committee Members.

Petitions for Admission to the Bar at Malacca High Court during “RMCO” – 25th June 2020

On the 25th of June 2020, the Malacca High Court was moved to enroll and admit 8 petitioners to the Bar. In this time of Recovery Movement Control Order (“RMCO”) period, the Court Officers and the Malacca Bar Committee Members were able to achieve an adequate standard of protocols and rules to be adhered by attendees. No doubt, it was indeed a memorable and joyous occasion for the petitioners and their family members.

.

The Malacca Bar records our appreciation and gratitude towards Yang Arif Puan Maidzuara Binti Mohamed, Judicial Commissioner of the High Court of Melaka for the privilege of preparing two separate speeches, personally written for the call ceremony, to inspire the young lawyers and to continue reminding all Members of the Bar of our role as an Advocate and Solicitor and an Officer of the Court.

MEETING WITH PEJABAT TANAH DAN GALIAN MELAKA

On 12 June 2020, the Malacca Bar Committee, represented by the Chairman, Jaspal Singh Gill, and the Conveyancing Practice Subcommittee Chairman, Datuk Shashi Kannan, had a meeting with the Pejabat Tanah dan Galian (PTG) Melaka to discuss a number of issues and problems faced by lawyers that cropped up in respect of land dealings during Movement Control Order (“MCO”) and Conditional MCO (“CMCO”).

.

The Malacca Bar Committee was represented by Nitin Kumar Gordhan and Chen Vi Vian of the main Committee, and Datuk B.K. Goh, Datin Zalina Zainuddin, Datin Siah Li Mei, and Ezam Shah of the Conveyancing Practice Subcommittee. The officers from the PTG were Tuan Mohamad Samsi Bin Kamarudin (Timbalan Pengarah Pendaftaran) who represented the Pengarah, Nabilah bt Nizam, Nik Farah Binti Nik Nubli, Rosbiana bt Abdul Razak and Rafzah bt Jasin.

.

A number of issues were discussed during the meeting, namely:-

  1. The time taken to fix appointments for presentation of documents at the PTG was too long.
  2. The limit of 5 transactions for each firm resulted in a backlog of presentations.
  3. The issue of late penalty charges imposed on transactions which fell due during the MCO and CMCO, and whether a waiver would be granted.
  4. Foreign quota requirements and issues relating the Estate Land Board.

.

The meeting was very cordial and a number of matters were resolved. The Malacca Bar Committee will be issuing a circular to update members on this meeting.

.

The Malacca Bar Committee takes this opportunity to record our appreciation to PTG Melaka for being responsive and acceding to our request for this meeting, and coming to a common platform to resolve all issues that were discussed.

On the 11th of June 2020, the Malacca Bar Committee was privileged and honoured to be able to obtain a session with our Malacca High Court Judge, Yang Arif Puan Maidzuara binti Mohammed, Judicial Commissioner of High Court Melaka 2. Due to the strict Standard of Protocols practiced in the Melaka Court and to avoid crowds during this pandemic, only a selected number of committees were able to attend the courtesy call. The courtesy call had initially been fixed on the 19th of March 2020 but had to be called off due to the Movement Control Order.

.

Among the Committee Members who attended were Jaspal Singh Gill (Chairman), Nitin Kumar Gordhan (Bar Representative), Chan Chee Yuan (Sports), Andrew Law Ching Hui (IT/Website), Chen Vi Vian (CPD), Desiree Teh Ken Wen (Court Liaison) and Radiance Chin Khee Yoong (Secretary and Social, Welfare & Charity).

SCANNING OF QR CODE FOR ENTRY INTO MALACCA COURT COMPLEX

The Malacca Bar Committee has been notified that the Malacca Courts will be implementing the scanning of a QR Code prior to entering the Malacca Court Complex effective from 1 June 2020 as an alternative to the “Borang Pelawat ke Mahkamah”.

The QR Code is contained in the attached document issued by the Chief Registrar’s Office of the Federal Court.

.

.

Members will need to scan the QR Code using their mobile phone, and the “Borang Pelawat Ke Mahkamah” will appear in e-form. Members will be required to key in their particulars on the e-form prior to entering the Court Complex, and present the same to the guard at the Security Booth who will record their body temperature before being allowed to enter the Court Complex.

.

As the e-form of the “Borang Pelawat Ke Mahkamah” can only be filled up on the day you will be appearing in Court and not in advance, you are advised to:-
* Print out a copy of the QR Code for easy access to the QR Code; or
* Save the QR Code in the photo album of your mobile phone, and download a QR Code Reader Application which will be able to scan the QR Code directly from the photo album.

On the 19th of May 2020, the Malacca Bar Committee was privileged and honoured to be able to obtain a session with our Malacca High Court Judge, Yang Arif Datuk Wira Haji Ahmad Nasfy bin Haji Yasin at the High Court Melaka 1. Due to the strict Standard of Protocols practiced in the Melaka Court and to avoid crowds during this pandemic, only a selected number of committees were able to attend the courtesy call.
